The Fair Debt Collection Practices Act (FDCPA)
The FDCPA gives consumers the right to dispute debts, request debt validation, limit communications from collectors, and pursue damages when collectors violate the law. Within five days of initial contact, a collector must provide written notice of the amount owed, the creditor’s name, and your right to dispute. If you dispute in writing, collection activity may need to stop until proper verification is provided.
Maryland Consumer Protection Laws
The Maryland Consumer Debt Collection Act prohibits collectors from attempting to enforce rights they know do not exist, collecting a debt you do not owe, or doing anything that violates the FDCPA. Unlike federal law, Maryland law applies not only to third-party debt collectors, but also to original creditors.
