Common Forms of Wrongful Debt Collection

Collection on Invalid or Inaccurate Debts

Collectors frequently pursue debts that were already paid, discharged in bankruptcy, or never belonged to the consumer. Others seek payment on time-barred debts or inflate balances with unauthorized fees and interest.

False Statements and Deceptive Practices

Collectors cannot falsely claim to be attorneys or government officials, threaten lawsuits they don’t intend to file, or suggest consumers face criminal prosecution for failing to pay. These tactics cause real emotional and financial harm.

Privacy Violations and Improper Contact

Collectors cannot contact your family members, employer, friends, or coworkers about an alleged debt. They also cannot continue contacting you after being told to stop or after learning you have an attorney.

Your Legal Protections

The Fair Debt Collection Practices Act (FDCPA)

The FDCPA gives consumers the right to dispute debts, request debt validation, limit communications from collectors, and pursue damages when collectors violate the law. Within five days of initial contact, a collector must provide written notice of the amount owed, the creditor’s name, and your right to dispute. If you dispute in writing, collection activity may need to stop until proper verification is provided.

Maryland Consumer Protection Laws

The Maryland Consumer Debt Collection Act prohibits collectors from attempting to enforce rights they know do not exist, collecting a debt you do not owe, or doing anything that violates the FDCPA. Unlike federal law, Maryland law applies not only to third-party debt collectors, but also to original creditors.
